Appeals: Civil or Criminal

Handling appeals is unlike handling trial cases. Appeals courts do not receive testimony and evidence themselves, only the record of the testimony and evidence received by the trial court. Framing the issues on appeal takes a combination of trial level experience and the knowledge of the legal issues presented along with the ability to write a clear and effective legal brief. Much like trial court work, it is experience that counts. How should the case be presented? Is the record from the trial court complete? Which argument is most likely to succeed? Can I get a new trial?
