Upon retaining our firm, we will investigate the case by
obtaining the police reports, copies of video or audio tapes if available
and records for the breath test machine, to determine the following: |

POLICE REPORTS:
|
- Was your vehicle lawfully stopped?
- Were you read your rights against self-incrimination (Miranda)?
- Did the officer accurately record the facts in his/her report?
- Were there any independent witnesses at the scene?
- Can evidence be suppressed?

FIELD SOBRIETY TESTS:
|
- Did the officer comply with the Florida Standard Field Sobriety
Testing procedures?
- Were the type of Field Sobriety Tests administered appropriate given
your age, height, weight, balance or physical condition or disability?
- Were the FSTÕs administered to you, affected by wind or weather
conditions, geographical location, poor lighting, traffic or other
type of disturbances?
- Was a video tape taken of your Field Sobriety Tests?
- Does the video tape accurately reflect your performance?

BREATH TESTS:
|
- Was the breath test machine properly maintained, calibrated and
certified? (Failure to do any of these could lead to exclusion of
test results.)
- Was the breath test operator property trained, qualified and licensed
at the time of your test?
- Could the breath test result be affected by burping, hiccoughs,
paint fumes, gasoline or a physical illness such as a fever or a physical
condition such as diabetes?
- Was your decision to take the breath test the result of duress,
coercion or misstatement of the law?
- If you refused to take the test, whether this fact hurts or helps
your case

BLOOD TESTS:
|
- Did law enforcement have the right to request a blood test from
you or forcibly withdraw blood?
- Was the person drawing blood qualified to do so, and did he/she
use a nonalcoholic swab?

OPTIONS:
|
DUI charges in some instances . . . can be handled without
the cost of a trial; can be handled without a court appearance; can be
reduced by the prosecutor to a lesser charge of reckless driving; can
