BREATH TESTS:
  • Was the breath test machine properly maintained, calibrated and certified? (Failure to do any of these could lead to exclusion of test results.)
  • Was the breath test operator property trained, qualified and licensed at the time of your test?
  • Could the breath test result be affected by burping, hiccoughs, paint fumes, gasoline or a physical illness such as a fever or a physical condition such as diabetes?
  • Was your decision to take the breath test the result of duress, coercion or misstatement of the law?
  • If you refused to take the test, whether this fact hurts or helps your case
BLOOD TESTS:
  • Did law enforcement have the right to request a blood test from you or forcibly withdraw blood?
